Terms of Service

Effective June 1, 2026

watchdarkly.com (“the Service”) is operated by Watchdarkly LLC, a Colorado limited liability company (“watchdarkly”, “we”, “us”). By using the Service you agree to these terms. If you don't agree, don't use the Service.

The Service

watchdarkly is a horror motion-picture catalog with community ratings, reviews, watchlists, and recommendations. You may browse without an account. You need an account (via Clerk) to rate, review, vote, save favorites, or submit films.

Your account

  • You must be at least 13 years old to use the Service.
  • You are responsible for activity on your account. Keep your credentials secure.
  • One human, one account. Don't use the Service via bots or automation.
  • We may suspend or terminate accounts that violate these terms, abuse rate-limits, harass other users, or submit obvious spam.

Your content

You retain ownership of the ratings, review text, and submissions you create (“Your Content”). By posting Your Content you grant watchdarkly a worldwide, royalty-free, non-exclusive license to host, display, reproduce, aggregate, and use it as part of the Service — including in helpfulness rankings, recommendation aggregates, and indexed search results — for as long as you keep your account active.

If you delete Your Content or your account, we'll stop displaying it within 30 days. Aggregate signals derived from Your Content (e.g. a film's average score) may persist in anonymized form.

Content rules

Do not post content that:

  • Is illegal, threatening, harassing, hateful, or sexually explicit.
  • Targets a real person by name with insults or defamatory claims.
  • Infringes someone else's copyright, trademark, or other rights.
  • Contains spam, advertising, or links unrelated to the film discussion.
  • Spoils plot points outside the dedicated spoiler-marked field.

Reviews scores lock 30 days after submission to discourage retaliatory edits. Review text remains editable to fix typos or update your take. We may edit or remove content that violates these rules.

Voting

You may vote “helpful” or “unhelpful” on other users' reviews, with one vote per review. You may not vote on your own reviews. Manipulating vote totals via additional accounts or coordinated voting is prohibited and grounds for account termination.

Film metadata & artwork

Film titles, posters, backdrops, runtime, and synopses are sourced from TMDB under their public API license. This product uses the TMDB API but is not endorsed or certified by TMDB. Poster art is the property of the respective rights holders.

Copyright & DMCA

watchdarkly complies with the Digital Millennium Copyright Act (17 U.S.C. §512). Our Designated Agent is registered with the U.S. Copyright Office under Registration Number DMCA-1073275 in the public directory of designated agents.

Sending a notice of claimed infringement

A valid notice under 17 U.S.C. §512(c)(3) must include:

  • Your physical or electronic signature.
  • Identification of the copyrighted work claimed to be infringed.
  • The URL or specific location of the allegedly infringing material on watchdarkly.com.
  • Your contact information (address, telephone, email).
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the rights holder.

We will respond promptly to valid notices, may remove or disable access to the material pending review, and will notify the user who posted it.

Counter-notice

If you believe your content was removed in error, you may send a counter-notice to the Designated Agent containing the elements required by 17 U.S.C. §512(g)(3). Per statute, we will restore the material in 10–14 business days unless we receive notice that the original complainant has filed suit seeking a court order against you.

Repeat infringers

In accordance with 17 U.S.C. §512(i), accounts that receive repeated valid takedown notices will be terminated.

Misrepresentations

Knowingly material misrepresentations in either a notice or a counter-notice may subject you to liability for damages under 17 U.S.C. §512(f).

Disclaimers

The Service is provided “as is” without warranties of any kind. Ratings, recommendations, and reviews are user-generated opinions, not professional reviews. We do not guarantee uptime, accuracy of metadata, or the relevance of recommendations.

Limitation of liability

To the maximum extent permitted by law, watchdarkly is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim is limited to USD $100.

Changes to the Service or Terms

We may modify or discontinue features at any time. We may update these terms; material changes will be announced on the site for at least 14 days before they take effect. Continued use after that constitutes acceptance.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to its conflicts-of-law principles. You agree that any dispute arising from these terms or your use of the Service will be resolved exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of those courts.
